Terms of Service

1. Acceptance of Terms

By accessing or using the LeadKatch web application, Chrome extension, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and LeadKatch ("we," "our," or "us").

2. Account Registration

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that contain inaccurate information or are used in violation of these Terms.

3. Subscription and Billing

Plans and Pricing

The Service is offered on a monthly subscription basis. Current pricing is available on our website. We reserve the right to change our pricing with 30 days' prior notice. Price changes will take effect at the start of your next billing cycle.

Free Trial

New accounts may be eligible for a free trial period. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial expires. You will not be charged during the trial period.

Billing

Subscriptions are billed monthly in advance. All payments are processed securely through Stripe. By subscribing, you authorize us to charge your designated payment method on a recurring basis. All fees are quoted in U.S. dollars and are non-refundable except as expressly stated in these Terms.

Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to the Service until the end of your current billing period. No partial refunds will be issued for unused time within a billing cycle. After cancellation, your data will be retained for 90 days before permanent deletion.

4. Acceptable Use

You agree to use the Service only for its intended purpose of managing Google Local Service Ads leads and CRM integrations. You shall not:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to gain unauthorized access to any part of the Service or its related systems
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any aspect of the Service
• Use the Service to send spam, unsolicited communications, or misleading messages
• Share your account credentials with unauthorized third parties
• Use automated tools (other than our Chrome extension) to interact with the Service
• Resell, sublicense, or redistribute the Service without our written consent

5. Intellectual Property

The Service, including its software, design, text, graphics, logos, and all related intellectual property, is owned by LeadKatch and is protected by applicable copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your business purposes in accordance with these Terms. You retain ownership of all data you submit to the Service.

6. Chrome Extension Usage

The LeadKatch Chrome extension is designed to operate exclusively on the Google Local Service Ads dashboard. By installing the extension, you grant us permission to read and interact with data on the Google LSA dashboard on your behalf. The extension does not modify, access, or collect data from any other websites. You are responsible for ensuring that your use of the extension complies with Google's terms of service and any applicable third-party agreements.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEAD KATCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

8. Indemnification

You agree to indemnify, defend, and hold harmless LeadKatch and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

9. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, with or without notice, for conduct that we determine violates these Terms, is harmful to other users or third parties, or is otherwise objectionable. Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination shall remain in effect.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your account.
